You will not get high from our hemp derived product. Some products do contain THC (<.3%), however it is only enough to enhance the medicine and not get you “high”. The Agriculture Improvement Act of 2018 was signed into law December 20, 2018. Section 10113 of the 2018 Act amended the Agricultural Marketing Act of 1946 (7 USC 1621 et. Seq.) to define “Hemp” as “. . . the plant Cannabis sativa L. and any part of that plant, including the seeds thereof and all derivatives, extracts, cannabinoids, isomers, acids, salts, and salts of isomers, whether growing or not, with a delta-9 tetrahydrocannabinol concentration of not more than 0.3 percent on a dry weight basis.” Also, Section 12619 of the 2018 Act amended Section 102(16) of the Controlled Substances Act (21 USC 802(16)) to amend the definition of Marihuana so as not to include “Hemp” as defined under the amended definition. While it appears that the debate on the legality of CBD from Industrial Hemp is settled, Congress did provide the states with the authority to impose stricter regulations on Hemp production and therefore CBD beyond those prescribed in the 2018 act. Consequently, the legality of Hemp derived CBD is still subject to a state by state analysis. It is up to each customer to find out on their state level, whether CBD Oil is legal in their state.
